1. Acceptance

By creating an account or using EmoteGenerator, you agree to these Terms of Service. If you do not agree, do not use the service.

2. Service Description

EmoteGenerator is an AI-powered Twitch emote generation platform. Users purchase credits to generate custom emotes using AI image models. Credits are consumed per generation.

3. Credits & Payments

• Credits are purchased in packages (Starter, Creator, Pro).
• Credits do not expire and are non-transferable between accounts.
• All prices are in EUR/USD and include applicable taxes.
• Payments are processed by Stripe. We do not store payment details.

4. Refund Policy

Credits that have not been used may be refunded within 14 days of purchase. Used credits are non-refundable. To request a refund, contact us at support@emotegenerator.com with your order details.

5. Content & Intellectual Property

• You own the emotes you generate using EmoteGenerator, provided they do not infringe third-party intellectual property rights.
• You may use generated emotes on Twitch, Discord, and other platforms.
• You may not use EmoteGenerator to generate content that is illegal, hateful, or infringes third-party rights.
• EmoteGenerator retains all rights to its platform, branding, and technology.

6. Copyright & Trademark Compliance

You are solely responsible for ensuring that any content you generate does not infringe the intellectual property rights of third parties, including but not limited to:

• Copyrighted characters (e.g. Superman, Batman, Mickey Mouse, Pikachu, or other fictional characters owned by studios or publishers)
• Trademarked logos, symbols, or brand identities
• Likenesses of real persons without their consent

Generating emotes that reproduce or closely imitate protected characters or logos — even via AI prompts — may constitute copyright or trademark infringement. EmoteGenerator does not review content before generation. You assume full legal responsibility for the content you create and how you use it.

7. Twitch Policy Compliance

You are responsible for ensuring that generated emotes comply with Twitch's Terms of Service and Emote Guidelines before uploading them to your channel.

8. Prohibited Use

• Generate illegal, defamatory, or harmful content
• Intentionally reproduce copyrighted characters, logos, or trademarks owned by third parties
• Impersonate real people or brands without consent
• Attempt to reverse-engineer or scrape the platform
• Create spam or automated abuse of the service

9. DMCA & Copyright Notices

EmoteGenerator respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA). If you believe content on our platform infringes your copyright, please submit a takedown notice to our designated DMCA agent. See our DMCA Policy for details on how to file a notice and our response process.

10. Disclaimers

EmoteGenerator is provided "as is." We do not guarantee that AI-generated emotes will meet Twitch's approval requirements. We reserve the right to modify or discontinue the service at any time.

11. Governing Law

These terms are governed by the laws of Germany. Disputes shall be resolved in the courts of Dortmund, Germany.
